Spain: 233,800 Euro fine for loss of broccoli batch

The Provincial Court of Murcia has confirmed the ruling that sentenced a company to pay another 233,800 Euro for the loss of 346,000 kilos of broccoli, which had been delivered for its conservation and which was damaged as a result of the temperature of the chambers being higher than agreed beforehand. In July 2016, a first instance court in Cartagena found that the defendant company, DGG, should have kept the goods delivered by the plaintiff at a temperature not higher than 2.5 degrees Celsius.

Throughout the procedure, it was confirmed that the broccoli had at times been subjected to temperatures between 4 and 8 degrees Celsius, which was the reason why the judges consider that contractual negligence had occurred. The fine, imposed as compensation, not only includes the value of the goods, but also the 1,842 Euro that their destruction cost.
