Spain: 8,000 Euro fine for sale of infected onions

The Provincial Court of Murcia has dismissed the appeal filed by a seed company of Albacete against the ruling of a Court of First Instance of Totana, which sentenced it to pay an 8,000 Euro fine to a grower for supplying him with onions infected with a virus.

The ruling, to which the news agency Efe has had access, fully accepted the claim submitted by the buyer and condemned the company "S.D., S.L." to the payment of said fine, plus legal interest accrued since the filing of the claim.

In its appeal, the defendant alleged that the facts had already been tried by a court of Villarrobledo, in Albacete, and that, moreover, they fell under the statute of limitations.

It also alleged that the Court of Totana had made an incorrect assessment of the evidence when it came to the origin and assessment of the damages suffered by the client.

With the dismisal of the appeal, it was corroborated that the court acted correctly when estimating the claim.

It was thus officially confirmed that forty percent of the onions supplied were affected by the virus and that the damage was evaluated by an agronomist.
