Spain: Nadorcott variety legal battle successes for CVVP

Over 3 years ago now, the Nadorcott variety licensees started a legal battle via their association CVVP, to defend their legitimate interests against those who have ignored variety owner rights and have been grafting Nadorcott variety clementines without a license. Nadorcott clementines are marketed by CVVP under the brand name Clemcott.

The legal battle has been going on for some time, however, now there are some results that are starting to come in that indicate the group is progressing successfully.

All the demands lodged by CVVP have obtained favourable results. CVVP have been supported by Garrigues legal firm from the outset and has filed a large number of demands - 34 of which have just been resolved, 12 with favourable sentences. In the case of 3 of these there was no option granted to appeal.

The other demands were settled out of court, with the defendants acknowledging, in all cases, the position put forward by CVVP.

The successes have led to the removal of 81,000 graftings over a cultivation area of 193ha.

The group continues to take a firm stance in the defence of their associates interests.
