no protection forgotten vegetables

Poland summoned by the European Court of Justice

The European Commission has recently decided to summon Poland to appear before the European Court of Justice. The country did not meet its obligations in protecting the bio-diversity and to maintain the 'forgotten' kinds of vegetables.

The guideline 2000/145/EG about maintenance of vegetable varieties has not been adequately observed by Poland. In this way Poland did not fulfil its obligations within the European law.

The bio-diversity and the maintenance of vegetables, which traditionally are grown in certain regions are threatened by genetic erosion. It is very important to maintain the rich biological multiple and the protection within the EU. Part of this is protection of vegetable varieties in the EU, the existence of which is threatened. It is obviously important that these vegetable varieties remain being used and are preserved for future generations.

EU member states should have met the obligations of the guideline before 31 December 2010. As Poland even after a warning did not take action the European Commission have decided to hand over the case to the Court of Justice.
