Nador Cott sues nine UK retailers over unauthorized sales of Tango mandarin

Nador Cott Protection S.A.S., a firm specializing in scientific research and development, and holder of the intellectual property rights for the Nadorcott mandarin under UK Plant Breeder Right, has initiated legal proceedings against nine major UK retailers for unauthorized sales of the Tango/Tang Gold mandarin. On January 2, 2025, Nador Cott launched a lawsuit against Asda, the UK's second-largest retailer, for patent infringement, following a successful settlement with Sainsbury's in the previous year.

The lawsuit emphasizes the importance of intellectual property rights in the agricultural sector, focusing on the "Tang Gold" mandarin as an "Essentially Derived Variety" of the Nadorcott mandarin, protected by UK Plant Breeder Rights. This case highlights the challenges of agricultural practices and the commercialization of specific plant varieties across different jurisdictions. The unauthorized use of patented varieties, especially by major retail chains with global operations, is a growing concern.

By taking legal action, Nador Cott aims to safeguard its investment in breeding and developing the "Tang Gold" mandarin, which involves considerable research and development costs.
