Fresh Del Monte has announced legal actions in response to reports about the illegal cultivation and harvest of pink pineapple in Nicaragua. This decision follows Nicaraguan media reports highlighting the "successful" production of this variety by Bernar Miranda, a Costa Rican based in Nueva Guinea. According to Miranda, the objective is to establish a seedbed to offer seeds to local producers, promoting a new agricultural alternative.
Fresh Del Monte stressed that if they corroborate any unauthorized production or distribution of this fruit, they will evaluate what legal actions to take against the parties involved in the infringement of intellectual property rights. The company is willing to cooperate with the authorities to investigate and take action against possible cases of illegal possession or sale of this variety.
The company claims to have exclusive rights, having received Costa Rica's approval to research and develop the Rosé variety two decades ago. Fresh Del Monte emphasizes that this variety is protected by intellectual property rights, which grant exclusivity in cultivation, production, and marketing. In addition, it guarantees that only the product purchased through the company complies with rigorous quality processes.
Fresh Del Monte already took legal action when it detected unauthorized sales of pink pineapple at farmers' fairs in Costa Rica. In June 2023, the State Phytosanitary Service identified farms where pink pineapple was being grown illegally and coordinated the destruction of identified areas. Some cases were taken to the judicial authorities due to the responsible parties' lack of cooperation.
