Breeders Trust: 200,000 Euro fine over around 1,000 tonnes of seeding goods

Considerable fine for Knud Kristensen ApS Denmark due to breeders infringement

Recently, Breeders Trust shareholder Danespo through its Danish breeding company, Vandel Potatoes in Give, won an important victory in higher appeal against the Danish potato trader Knud Kristensen ApS lead by Unipatatas large shareholder Jans Kristensen.

The dispute is from 2010, when the firm Knud Kristensen multiplied and traded the variety Folva, which is protected by breeder's rights, without permission. The court therefore ruled that there had been a breach of the Breeder's Rights. Knud Kristensen ApS was ordered to compensate all losses including potential profits for the variety's owner. The compensation was set at € 134 per tonne by the court in Viborg, which resulted in a total amount of € 133,000. On top of this, Kristensen was ordered to pay the court and additional costs such as the interest rate, an amount of over € 55,000.

In response to this a satisfied Breeders Trust director, Geert Staring, said. "A fine of almost 200,000 Euro all together for around 1,000 tonnes of seeding good. We will let the world know that everyone knows what they're up against if they think they can multiple and trade protected seeding goods without permission."
