USDA restricts 12 PACA violators from operating in the produce industry

The U.S. Department of Agriculture (USDA) has imposed sanctions on 12 produce businesses for failing to meet contractual obligations to the sellers of produce they purchased and for failing to pay reparation awards issued under the Perishable Agricultural Commodities Act (PACA). These sanctions include suspending the businesses' PACA licenses and barring the businesses' principal operators from engaging in PACA-licensed business or other activities without USDA approval.

The following businesses and individuals are currently restricted from operating in the produce industry:

  • Sasita Produce LLC (Vestavia Hills, Ala.) for failing to pay $137,262 in favor of a Texas seller. As of the issuance date, Severo Perez was listed as member/manager.
  • Fresh Produce Point LLC (Tampa, Fla.) for failing to pay $12,752 in favor of a Texas seller. As of the issuance date, Michael Webb was listed as business manager.
  • Inter Connect Fresh LLC (McAllen, Texas) for failing to pay $31,512 in favor of a Texas seller. As of the issuance date, Jose S. Ruiz was listed as sole member.
  • Éclair Inc. (Commerce, Calif.) for failing to pay $71,377 in favor of a California seller. As of the issuance date, Hong Chul Han and Kenny Roh were listed as officers, directors, and major stockholders.
  • COOQ Merchants & Consulting Inc. (Miami, Fla.) for failing to pay $35,940 in favor of a Texas seller. As of the issuance date, Alejandro Badilla was listed as sole officer/director/stockholder.
  • SJYS Inc. (Detroit, Mich.) for failing to pay $17,779 in favor of a Michigan seller. As of the issuance date, Yousif Shamoon was listed as sole officer/ director/stockholder.
  • Fruver Inc. (Franconia, Va.) for failing to pay $19,026 in favor of a Texas seller. As of the issuance date, Cesar Argueta was listed as the sole officer/director/stockholder.
  • Samra Produce & Farms Inc. (Los Angeles, Calif.) for failing to pay $4,004 in favor of a California seller. As of the issuance date, Harbhajan Singh was listed as sole officer/director/stockholder.
  • Fresh Garlic & Produce Corp. (Miami, Fla.) for failing to pay $14,076 in favor of a New Jersey seller. As of the issuance date, Ricardo Hernandez Leon was listed as sole officer/director/stockholder.
  • Banana Bros. Produce LLC (Holly, Mich.) for failing to pay $23,033 in favor of a Michigan seller. As of the issuance date, Chelsey Gelardi was listed as sole member.
  • BLJR Distribution LLC (Conklin, N.Y.) for failing to pay $13,595 in favor of a California seller. As of the issuance date, Bradley Hurlburt, Leon Hurlburt, and Albert Palermo were listed as business members.
  • Fresh Market La Morenita LLC (Von Ormy, Texas) for failing to pay $11,201 in favor of a Texas seller. As of the issuance date, Rocio Gonzalez was listed as sole business member.
