In a complaint filed on Dec. 9, 2019, the U.S. Department of Agriculture (USDA) alleged that Mibo Fresh Foods LLC (Mibo Fresh), Ft. Worth, Texas, failed to make full payment promptly in the total amount of $1,861,502 to 14 sellers for multiple lots of produce in violation of the Perishable Agricultural Commodities Act (PACA).
After the complaint was filed, USDA and Mibo Fresh entered into a Consent Decision and Order wherein Mibo Fresh agreed to pay the unpaid produce sellers listed in the Appendix A to the Complaint and to pay a civil penalty in the amount of $22,500. As a result of Mibo Fresh satisfying the terms of the consent decision and order, the finding that it had committed repeated and flagrant PACA violations was permanently abated without further process and the case has been closed.
Also, in a complaint filed on May 7, 2020, the USDA alleged that So Ono Food Products LLC (So Ono), Honolulu, Hawaii, failed to make full payment promptly in the total amount of $1,344,994 to seven sellers for multiple lots of produce in violation of PACA.
After the complaint was filed, USDA and So Ono entered into a Consent Decision and Order wherein So Ono agreed to pay the unpaid produce sellers listed in the Appendix A to the Complaint and to pay a civil penalty in the amount of $22,500. As a result of So Ono satisfying the terms of the consent decision and order, the finding that it had committed repeated and flagrant PACA violations was permanently abated without further process and the case has been closed.
