Mexico: Agriculture should report on avocado producers

The National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), ordered the Secretariat of Agriculture, Livestock, Rural Development, Fisheries and Food (SAGARPA) to publicize a list of the companies operating in the country that are dedicated to the production, distribution and / or marketing of avocado.

This, after an individual requested SAGARPA for this information and SAGARPA indicated that the information required was the responsibility of the Ministry of Economy (SE), the Agri-Food and Fisheries Information Service (SIAP) and the Agency of Services for the Marketing and Development of Agricultural Markets (formerly ASERCA), and recommended the individual to go to these instances.

Unhappy, the individual filed an appeal for review with the INAI. However, in the allegations, SAGARPA reiterated its initial response.

The case was then referred to commissioner Oscar Guerra Ford, who, discovered that the General Directorate of Operations and Land Exploitation of the SAGARPA was the administrative unit that had the information required, as it is responsible for coordinating the development and use of the registers of crop producers and plantations of agricultural programs.

In addition, he added, this unit defines the criteria for the integration and use of geo-referenced information from inventories of infrastructure works, productive projects, and infrastructure for the commercialization of beneficiaries, crop producers, and plantations supported by agricultural programs.

Therefore, the plenary session of the INAI unanimously revoked SAGARPA's response and instructed it to assume its competence, activate the necessary search procedure in all of its administrative units, including the aforementioned administrative unit, and communicate the results to the appellant.

The INAI informed the requesting party that, if need be, he had the right to dispute SAGARPA's new response.
