Düsseldorf court confirms EDEKA transactions

EDEKA states that they welcome the decision of the Regional High Court (Oberlandesgerichts) Düsseldorf. “The current decision makes clear that our negotiations with the suppliers after the takeover of Plus in 2009 were correct and lawful,” explains the large supermarket chain in its press release.

We were counting on this decision and we were always convinced that at the time, we negotiated fairly and in full accordance with the antitrust legislation, EDEKA added.

“The excellent business development of the change from the Plus stores to the Netto Marken-Discounters and the sales and the revenue of the suppliers increased impressively in the meantime. The decision of the Regional High Court in Düsseldorf strengthens the competition in Germany and provides greater legal certainty for negotiations between trade and industry.”
