EU-Commission sues Germany at the European Court

The European Commission decided on Thursday to sue Germany for the Court of Justice of the European Union, because it has not completely implemented the directives on hazard prevention in the port of North Rhine-Westphalia.

Germany has engineered a plan of action, with which the obligations from the directive are to be fully implemented in North Rhine-Westphalia. However, the draft amendment for the harbor safety law has not yet been adopted by the North Rhine-Westphalian state parliament.

The Komission Deutschland has already been asked to fulfil its duties regarding risk assessment and the creation of a hazard prevention plan in its own port of North-Rhine Westphalia in September 2014. Because this has not happened yet, the Commission brings the case to the Court of Justice of the European Union. The directive had to be changed up to June 15, 2007.

The main goal of the European politics for hazard prevention in the harbor is to protect ships and port facilities from the risk of terrorist attacks as a maritime part of the logistical chain. With the directive to increase hazard prevention, all European ports should achieve a higher security level, especially by means of hazard prevention plans, which the measures for ensuring harbor security have been defined.
